TERMS & CONDITIONS

Preamble
Every order implies on the behalf of the buyer a full respect of the following general terms of sale of TRADING CO. LIMITED T/A TRUSTUS (hereinafter TRUSTUS). Therefore, every conflicting clause that may relates to the buyer's terms of sale is null and void and hence can't be applied to the seller (TRUSTUS), if he hasn't formally agreed on it.
Validity
This Proforma Invoice remains valid during 48 hours after the date stated in the upper right section. If the Proforma invoice is not sent back signed and chopped (by fax, mail or email) within 48 hours to TRUSTUS, it will be considered null and void, in this case TRUSTUS reserves the right to change the conditions and issue a new Proforma Invoice.
Billing Terms
30 % deposit of the total amount of the order is necessary to confirm the order (the order will be processed once the deposit is received).
For sea transportation, the balance should be paid against copy of Bill of Lading.
For air transportation, the balance should be paid before shipment of the goods.
All payment must be made by bank transfer to TRUSTUS.
Any other type of payment requires the express agreement of TRUSTUS based on special terms of sale.
In case of suspension of payment for any reason during or at the end of works, account are not refundable.
In case of cancellation on our behalf, the 30 % deposit will be refunded to the buyer.
Reservation of Title
TRUSTUS retains the ownership of the goods until full payment of principal and interest has been made. However the responsibility for deterioration, loss or theft of the equipment and product will be transferred to the buyer upon delivery.
Cancellation Policy
Cancelled orders will be charged according to the costs incurred at the date of the cancellation, including, but not limited to: moulding, screening, shipping and merchandise.
Completed orders are not subject to cancellation. All cancellations must be confirmed with TRUSTUS in writing through email.
Change of Order Policy
Changes to an order should be submitted to TRUSTUS within 48 hours of the original Proforma Invoice date. You can call us directly but all changes must be confirmed with TRUSTUS in writing through email.
Overrun and Underrun Policy
TRUSTUS makes a point of maintaining the ordered quantities. However TRUSTUS reserves the right to apply quantity deviation of +/- 5 % of the order quantity, in which case, we will only bill in accordance to the final count. No refuse from the buyer is accepted and no compensation will be given.
Quality Policy
Considering technical specificities inherent in some items, TRUSTUS reserves the right to +/- 5% qualitative deviation, especially regarding the colour of the items.
Return Policy
No returns are accepted for orders placed with TRUSTUS.
Delivery and Damages Policy
Buyers must inform TRUSTUS of any missing or damaged packages within two days of delivery. Damaged packages must be kept, as they may be requested in case of litigation.
The delivery address given by the buyer has to be precise and correct, as any extra fees due to change in the delivery address will be at buyer’s cost.
For Artwork
TRUSTUS reserves the right to determine if artwork submitted is appropriate for use.
TRUSTUS is not responsible for art or typesetting errors that occur after the point of approval.
Copyright and Trade Laws
TRUSTUS assumes that any phone numbers, titles, headings, texts, drawings, photographs, artwork is submitted in full compliance with all applicable laws governing copyright and trademarks. Purchaser, by placing the order, agrees to indemnify, defy, and hold TRUSTUS harmless from and against all claims, liabilities, and expenses (including attorney’s fees) arising our of or related to actual or alleged infringement or misappropriation of any trademark, copyright or any proprietary right of such merchandise. This provision remains in effect after the delivery of an order.
Proprietary Rights
The sales of the products to the buyer shall in no way be deemed to confer upon the buyer any right, interest or license to the copyright design TRUSTUS may have, covering the products. TRUSTUS retains for itself all proprietary right in and to all designs, engineering details, and other data and materials pertaining to any products supplied by TRUSTUS.
Shipping
TRUSTUS is not responsible for delays on part of the shipping carrier.
